1. ABOUT THESE TERMS

These Terms of Service (the "Terms") govern your use of the Sea Hero Quest mobile and web application (the "Game"), provided by Glitchers Limited ("Glitchers", "we", "us"), a company registered in England and Wales (number 08683349) with registered office at:

By installing, accessing, or using the Game, you agree to these Terms. If you do not agree, you should not install or use the Game.

These Terms should be read alongside our Privacy and Data Policy, which describes how we handle data collected through the Game.

2. THE GAME

Sea Hero Quest is a navigation game and research platform. By playing the Game, you contribute gameplay data, navigation data, and (where you choose to provide it) demographic information to a dataset used by Glitchers for scientific research and the commercial purposes described in Section 5 of these Terms and Section 3 of the Privacy and Data Policy.

The Game is provided free of charge in its base form. Some features may be offered on a subscription basis ("Sea Hero Quest Plus" and similar paid features), governed by the additional terms in Section 7 below.

3. ELIGIBILITY AND MINIMUM AGE

Anyone may download and play the Game. However, in order for your data to be included in our research dataset and any commercial use of that dataset, you must meet the following minimum age requirements:

• If you are located in the United Kingdom, you must be aged 16 or over.
• If you are located anywhere else, you must be aged 18 or over.

Players below these thresholds may play the Game in full, but their contributed data will be stored only for the purpose of being identified and excluded, and will not be used for research, commercial reports, the development of norms or benchmarks, or any other downstream purpose.

4. YOUR ACCOUNT AND GAMEPLAY DATA

4.1 Game-issued identifier

When you first launch the Game, our servers issue a unique identifier (a "UUID") for your installation. Your gameplay is associated with this UUID.

4.2 Optional account linking

You may optionally link your installation to a third-party authentication provider (currently Unity Authentication) using OAuth2, in order to transfer your data between devices or to access paid features. You may unlink your account at any time from within the Game's Settings.

4.3 Loss of data

If you have not linked your account and you uninstall the Game, replace your device, or clear local storage, your previous gameplay data may no longer be accessible to you. Glitchers cannot recover this data on your behalf, because we hold no information by which we can identify you in the dataset. This is a deliberate consequence of the privacy-preserving design of the Game.

5. LICENCE AND COMMERCIAL USE OF CONTRIBUTED DATA

5.1 Ownership of the dataset

The Sea Hero Quest dataset, in aggregate, is owned by Glitchers as a commercial asset. This includes the structured collection of contributed data, the schema and organisation of the dataset, and any norms, benchmarks, reports, analyses, or derivative works produced from it. Glitchers asserts database rights in the dataset under applicable law.

5.2 Licence you grant

This licence covers the data itself. It does not extend to any personal data we may separately hold about you (such as support correspondence), which is governed by UK GDPR and the Privacy and Data Policy.

5.3 Permitted commercial uses

Glitchers may use the dataset and any derivative works for any lawful purpose, including:

• Developing normative benchmarks describing population-level patterns in spatial cognition.
• Producing reports and analyses for partner organisations, including in the pharmaceutical, medical technology, healthcare, and insurance sectors.
• Developing new products, features, and research applications based on insights from the dataset.
• Licensing access to derived norms, reports, and analyses to commercial and academic partners.

5.4 Restrictions on our use

We do not sell raw individual-level data to third parties, and we do not permit third parties to onward-sell data they receive from us. Decisions about commercial use of the dataset are made by Glitchers.

5.5 No compensation

You acknowledge that you are not entitled to any payment, royalty, or other compensation in respect of any commercial use we make of the dataset, including any derivative works.

5.6 Research-project contributions

If you are using the Game as a participant in a research project operated by a university, hospital, or other research institution (see Section 10 of the Privacy and Data Policy), the licence in Section 5.2 does not apply to data contributed through that route. Data contributed through a research-project access route is governed by the agreement between Glitchers and the operating research institution.

6. PERMITTED USE OF THE GAME

You agree to use the Game only for its intended purpose. You agree not to:

• Reverse-engineer, decompile, or disassemble the Game, except to the extent permitted by law.
• Attempt to access or interfere with our servers, infrastructure, or other users' data.
• Use the Game to upload or transmit any unlawful, harmful, or infringing content.
• Use automated means (bots, scripts, scrapers) to interact with the Game, except with our prior written consent.
• Submit deliberately false demographic information, except where you do so to preserve your privacy (in which case your contribution may be excluded from the dataset).
• Use the Game in any way that breaches applicable law.

7. SUBSCRIPTIONS AND PAID FEATURES

7.1 Sea Hero Quest Plus

Sea Hero Quest Plus is an optional subscription that provides additional features. Subscriptions are purchased through and managed by the relevant app store (Apple App Store or Google Play Store).

7.2 Payment and billing

All payments for Plus subscriptions are processed by the relevant app store under their own terms. Glitchers does not receive, hold, or have access to your payment card details or billing address.

7.3 Cancellation and refunds

You may cancel a Plus subscription at any time through the relevant app store's subscription management settings. Refunds for subscriptions are handled by the app store and are subject to their refund policies. Glitchers is not able to issue refunds for subscription payments directly. For payment, renewal, or refund queries, please contact the relevant app store's support team.

7.4 Changes to subscription terms

We may change the features included in a subscription or the price of new subscriptions from time to time. Material changes affecting existing subscribers will be notified in advance through the Game or by other appropriate means.

8. INTELLECTUAL PROPERTY IN THE GAME

The Game, including all software, graphics, audio, level design, branding, and other content, is owned by Glitchers or licensed to us, and is protected by intellectual property law. We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the Game on devices you own or control, solely for personal, non-commercial enjoyment, in accordance with these Terms.

Sea Hero Quest and Glitchers are registered trademarks of Glitchers Ltd. All other trade marks referenced in the Game are the property of their respective owners.

9. DISCLAIMERS AND LIABILITY

9.1 No medical advice

9.2 Game provided as-is

To the maximum extent permitted by law, the Game is provided on an "as-is" and "as-available" basis. We do not warrant that the Game will be uninterrupted, error-free, or available at all times.

9.3 Limitation of liability

To the maximum extent permitted by law, Glitchers' total liability to you in connection with the Game, whether in contract, tort, or otherwise, is limited to the amounts (if any) you have paid to us for the Game or related subscriptions in the twelve months immediately before the event giving rise to the liability.

Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by our negligence and liability for fraud or fraudulent misrepresentation.

10. TERMINATION

You may stop using the Game at any time by uninstalling it. We may suspend or terminate your access to the Game, or to specific features, if you breach these Terms or if we are required to do so by law.

Termination of your access to the Game does not affect the licence you have granted to Glitchers under Section 5.2 in respect of data already contributed.

11. CHANGES TO THESE TERMS

We may update these Terms from time to time. The current version is always available at https://seaheroquest.com/terms. Where changes are material we will, where appropriate, notify you in the Game or by email.

12. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, except that if you are a consumer resident in another part of the United Kingdom or in the European Union, you may also bring proceedings in the courts of your place of residence, and these Terms do not deprive you of any protection afforded by mandatory consumer protection law in your jurisdiction.
